Dissolution of National Assembly
An act of the National Assembly, as ordered by the courts, to answer the constitutional question of transferring legislative powers following a dissolution of the National Assembly ordered by the Crown.
Provisions
- The Crown may order one of two types of dissolutions;
- A full dissolution in which the Premier and the National Assembly is removed
- A partial dissolution in which the assemblymen are removed, but the Premier remains in power
- Upon a full dissolution of the National Assembly;
- A Provisional Assembly shall be formed consisting of all the Sheriffs of each Shire.
- The Provisional Assembly shall set the date of a special election to replace the National Assembly with-in two days of forming.
- The Provisional Assembly may also pass emergency legislation that is temporarily effective until the new National Assembly is elected
- Upon a partial dissolution of the National Assembly;
- The Premier shall with-in two days set the date of a special election to replace the National Assembly
- No Provisional Assembly shall be formed
- No temporary legislation shall be passed
